Right to Counsel

Every person accused of a crime is presumed innocent, and cannot be punished with jail time, unless and until they proven guilty and convicted. Prior to trial or a guilty plea, the Texas Constitution guarantees individuals the right to post bail in most cases so that they can remain free while they face unproven government accusations.

Right to Liberty if You Can’t Afford to Pay a Debt

Imprisonment for debt is incompatible with American principles of liberty and equal justice. You may not be held in jail solely because you are unable to pay costs, fees, and other debt assessed against you in connection with your criminal case.
